eSky Wallet Terms and Conditions

  • § 1.
    Preliminary Information

    1. This document defines how to use eSky Wallet and the rules for the User to redeem the Points collected therein.
    2. eSky.pl S.A. is responsible for operating the eSky Wallet tool.
  • § 2.
    Definitions

    1. eSky Wallet - is an electronic wallet containing top-ups in the form of Points, made available to the User by eSky during the provision of eSky Services, as well as part of promotional campaigns in connection with services performed by eSky or for eSky. Points accumulated in eSky Wallet entitle the User to a discount on payments for eSky Services.
    2. eSky - eSky.pl Spółka Akcyjna, with its registered office in Katowice (40-265), at ul. Murckowska 14A, registered in the register of entrepreneurs maintained by the District Court Katowice-Wschód in Katowice, VIII Commercial Division of the National Court Register under KRS number 0000383663, NIP 948-19-87-199, REGON 670140736, share capital PLN 1,060,877.50.
    3. User - a person who has used eSky Services, received an application form from eSky, and consented to use eSky Wallet.
    4. eSky website - a website where eSky is the Administrator of the Booking System.
    5. eSky Services - airline tickets, flight+hotel packages, service packages, insurance, and additional services offered via the eSky website.
    6. Limit- the total value of Points accumulated in eSky Wallet.
    7. Original transaction price - the purchase price of an airline ticket made via the eSky website, for a flight cancelled by the airline, including the service package purchased from eSky and online check-in. The original transaction price does not include Airhelp+ services and purchased insurance.
    8. Original multi-leg flight transaction price - the purchase price of airline tickets (for one multi-leg journey), made via the eSky website, for flights cancelled by airlines. The original multi-leg flight transaction price does not include the price for the service package purchased from eSky, online check-in, Airhelp+ services, and insurance.
    9. Airline ticket - means a single airline ticket, airline tickets, and additional services purchased for the airline ticket provided by airlines as part of the flight, including in particular: checked baggage, priority boarding, seat selection.
    10. Partner System- means any website or mobile application managed by an eSky business partner, to which the User is redirected for verification or finalization of the transaction.
    11. Top-up Code- a document provided to the User, enabling a discount on payment for purchases using the eSky Wallet account, for Products offered by eSky.
    12. Points - a virtual designation visible within eSky Wallet awarded to the User on the terms specified in these Regulations. Points can be used to reduce payments for Products offered by eSky. One point is equivalent to 1 SGD.
  • § 3.
    General Information

    1. eSky, within eSky Wallet, allows the User to purchase eSky Services available on the eSky website for an amount equivalent to the Limit with a minimum additional payment of 1 SGD and using the following options:
      • repeated use of Points from eSky Wallet until the Limit is exhausted,
      • use of Points from eSky Wallet to order eSky Services with a value exceeding the Limit - in such a situation, the User will be obliged to pay the price difference.
    2. During the provision of eSky Services, as well as part of promotional campaigns, and through a top-up purchased in the Partner System, the User may acquire eSky Wallet Points.
    3. The amount of Points transferred to the User within eSky Wallet will be indicated in the communication sent to the User.
    4. The value of Points accumulated in eSky Wallet may reduce the fee for eSky Service purchase transactions carried out by the User.
    5. Points obtained within eSky Wallet are intended solely for use in paying for purchased eSky Services.
    6. Points accumulated in eSky Wallet will be available for use depending on their acquisition method within the specified period (Points validity period) from the date eSky makes the Points available to the User.
    7. To use the Points accumulated in eSky Wallet, the User can select a product from the Flights, Flight+Hotel, Holidays, City Break tabs, and additional services, including insurance, which may be subject to transactions using Points accumulated in eSky Wallet, if payment for them using eSky Wallet is available in the Booking System. If there are not enough Points in the eSky Wallet account, it is possible to make an additional payment.
    8. Only the User can order eSky Services using Points accumulated in eSky Wallet, although they may order eSky Services for a third party.
    9. eSky Wallet can be used in the manner indicated in these Regulations and the Service Regulations available on the eSky website.
    10. eSky is not responsible for the User providing incorrect data that prevents the use of eSky Wallet or eSky Services.
  • § 4.
    Conditions for obtaining and rules for using Points transferred to eSky Wallet instead of a refund for an airline ticket

    1. A User who has waived a refund from the airline for an airline ticket for a flight cancelled by the airline will receive Points from eSky within eSky Wallet:
      1. By choosing eSky Wallet, a User who has waived a refund for a single-leg airline ticket for a flight cancelled by the airline will receive Points from eSky within eSky Wallet equal to the Original transaction price increased by a monetary bonus indicated in the email correspondence received by the User.
      2. By choosing eSky Wallet, a User who has waived a refund for airline tickets purchased under a single reservation for one passenger, for a multi-leg flight where at least one segment was cancelled by the airline, will receive Points from eSky within eSky Wallet equal to the Original multi-leg flight transaction price increased by a monetary bonus indicated in the email correspondence received by the User.
      3. By choosing eSky Wallet, a User who has waived a refund for an airline ticket for a flight cancelled by the airline due to its liquidation or bankruptcy, will receive Points from eSky within eSky Wallet equal to the Original transaction price.
    2. Refunds for airline services constituting the value of the airline ticket will be transferred by eSky to the User's eSky Wallet immediately upon their receipt from the airline.
    3. Information about the transfer of Points to the User within eSky Wallet will be sent to the User's email address within 3 business days after eSky's positive verification of the User's email address. In the event of the User providing an incorrect email address, eSky will contact the User by phone to clarify any doubts.
    4. If the User does not use the Points accumulated in eSky Wallet after 18 months of eSky Wallet validity, these Points will not be redeemable and will be cancelled.
    5. In the event of ordering an eSky Service with a value lower than the value of Points accumulated in eSky Wallet, the User is not entitled to withdraw the remaining, unused amount.
    6. By choosing the eSky Wallet service, the User waives claims for a monetary refund of Points in respect of a refund for an airline ticket for a flight cancelled by the airline.
    7. eSky reserves the right to cancel Points made available to the User in eSky Wallet instead of a refund for an airline ticket for a flight cancelled by the airline, in the event that the User receives or has received a refund for the airline ticket or other benefit (as an equivalent of the unused airline ticket) directly from the airline or another entity despite an earlier refund of funds for the airline ticket to eSky Wallet.
    8. In the event of cancellation of Points under the rules specified in point 7 above, the User will not have the right to use the cancelled funds and their Limit will be reduced by the value of the cancelled Points.
  • § 5.
    Conditions for obtaining and rules for using Points transferred to eSky Wallet as part of promotional campaigns

    1. As part of promotional campaigns, eSky may transfer Points to the User, increasing the value of eSky Wallet.
    2. The rules for individual promotional campaigns resulting in an increase of eSky Wallet Points will be made available to the User on a durable medium each time.
    3. Points obtained in eSky Wallet as part of promotional campaigns are not redeemable for cash.
    4. Points transferred to eSky Wallet as part of promotional campaigns are valid only for the period indicated in the terms of the respective promotional campaign. After the validity period expires, these Points will be cancelled and cannot be used. The User cannot withdraw unused Points accumulated in eSky Wallet as part of promotional campaigns.
    5. In case of an interpretative discrepancy or conflict between the provisions of the eSky Wallet Regulations and the Promotional Campaign Regulations, the provisions of the Promotional Campaign Regulations shall prevail.
  • § 6.
    Conditions for obtaining and rules for using Top-up Codes provided by eSky

    1. The Top-up Code is provided to Users for use in eSky Wallet. The Top-up Code entitles the User to increase Points in eSky Wallet and to receive a discount on the fee for purchasing Products offered by eSky.
    2. Top-up Codes are not issued to Users with whom eSky cooperates, or to Users employed by eSky under an employment contract, cooperation agreement, or B2B contract, unless the promotion regulations state otherwise.
    3. Top-up Codes allow for a discount on the fee for purchasing services offered on the eSky website.
    4. Top-up Codes may be received by the User via email or other method agreed with the User.
    5. When using a Top-up Code to purchase a service, the User is always obliged to pay at least 1 SGD additionally.
  • § 7.
    Complaints

    • All complaints related to the execution of eSky Wallet and eSky Services will be handled by eSky in accordance with the complaint procedure specified in the Service Regulations available on the eSky website.
  • § 8.
    Final Provisions

    1. eSky is not liable for the User's loss of a document, code from an electronic medium or other form of confirmation of using Points accumulated in eSky Wallet, or for the use of Points accumulated in eSky Wallet by a third party.
    2. The User using eSky Services with Points accumulated in eSky Wallet is bound by the booking and tariff conditions of the entity directly providing these services.
    3. Any copying, distribution of the document, code from an electronic medium or other form of confirmation of using Points accumulated in eSky Wallet, inconsistent with its intended use, is prohibited. eSky informs that any attempts to illegally use eSky Wallet Points will be reported to the relevant law enforcement authorities.
